As per the judicial law, a person who is single is eligible to apply to the court. If a person is already married and living in an active relationship with the current partner, then she is not eligible to apply for a court marriage. If a person is divorced and attains a dedicated divorce certificate from the court, then the person is eligible for a court marriage. During the documentation, it is mandatory for that person to show their respective divorce certificate.
If it is found that the person applied for remarriage is not single and already in an active relationship then that person is doing an illegal thing. Judicial bodies will take serious actions against the person and cancel the marriage application.
